If I have a LIVE membership and am connected, but no one else is in the game with me, can I still get banned? People seem to talk about it like Microsoft has an all seeing eye that lets them know even without you getting reported.

Yes and its better, do not do it. Then you can't get banned and you be safe then from being banned, cuse yure to dumb

Strictly speaking, yes any mods can get you banned. However, you're a lot less likely to get caught doing anything in a single-player game than you would if you're online.
