Is this legit? I have a server named farcraft and someone said its their name via email?

Trademarks do not grant universal rights to a name. They are established to protect businesses from having their name used by someone else in such a way that it could confuse their customers into thinking the other entity is related or sanctioned by them.

I don't know what farcraft is, what your use of it is, or what Ray's use of the term is. If your use and Ray's use are not related to each other (e.g. He makes a machine that does remote arts & craft while you are doing some far off space craft design), then your use would not infringe upon his trademark. Just because someone trademarks the term Farcraft, it doesn't grant him the universally exclusive right to use that name.

If your use of the term can't be confused with his use of it, then you are not obligated to cease and desist.

I just took a quick look on TESS and don't see a mark for "farcraft". It's probably bull.

Trademark is to prevent consumer confusion about the source of goods and services. If you're doing something with "Farcraft" that would cause consumer confusion with what this other person is doing, you need to stop.

Trademark holders do need to enforce their trademark or they can lose it.

If you're just running some server that has a name, it's not clear if it would really get confused with this other person's gaming universe, but it appears it might.

Yes, this appears legitimate. And best I can tell with what what's presented here, you probably should change the name of your server to prevent any possible confusion. I don't know that this person would readily be able to take a ton of legal action, but it does appear you're likely stepping on the toes of their trademark.

(And by the way, you probably should be posting everything word for word on the internet, including their name. You're going to get yourself in a whole new set of legal issues with stuff like that.)

Are you in the USA? Have you searched the US Trademark database? Farcraft is not there, so if you are in the USA, you are not violating any laws by calling your server Farcraft. You might want to obtain legal counsel to be safe. Just because they say they own the trademark doesn't mean they actually registered it. If it is not registered, you are probably OK.

If you are just some kid running a server you might just want to change your server name. It would be the cheapest and easiest way to go.

Talk to a lawyer about this to see if they indeed have the right to enforce their ownership of the name Farcraft.
