Ok so I have everything set up correctly, but when I try to sign my brother in for split screen multiplayer, I gives that playstation error 80028e06 and can't sign him in. What do I do

PSN changed their terms and conditions recently so you won't be able to use an account until you have accepted the new T&C's. Turn off your PS3, goto your brothers PSN account and sign in. It will tell you to read and accept the new terms and conditions. When you have accepted and PSN has signed in, you should now be able to play split-screen with that account.
