I was thinking of creating an mmorpg after the anime show sword art online, to do so i was thinking of basically using minecraft as the base and not having any aspect of sandbox except for buying a plot of land for a player owned house, and buying the materials from a vendor. There would be no monsters from minecraft, i would do my best to smooth out characters, and world design etc. So what i'm asking is if i can get slapped with a lawsuit for using minecrafts code as a base for this game using java. And if i claim no ownership etc to the sao (sword art online) franchise. I may not use minecraft for that i'm just thinking that would be easiest to start with as my skills with java are mediocre at best.
Could making this game result in a lawsuit?
Minecraft permits modding so you're probably fine on that front, to the extent that you do not attempt to profit from your mod (i.e., sell it commercially). Saying you do not own SAO but are going to use copyrighted SAO materials isn't really much of a disclaimer; it's like saying "I don't own this computer, and I don't know who it belongs to either, but I'm going to take it anyways." Also, copy pasting "Fair Use" does not make an improper or unfair use suddenly a fair use if it was never one to start with. Something to think about is that all unauthorized fan fictions are copyright infringements. Another thing to think about is that fan fictions are rarely prosecuted because such fan works are rarely sold for profit and thus there's no money in it for the studios to sue for. Before you even get close to being served a lawsuit you'll more likely be handed a cease and desist letter; it's simply a warning that says if you don't quit now you'll get sued. So, if you were just making this game for fun, to practice your coding skills, and weren't intending to somehow make a profit from it, then it won't be worth anyone's time to rack up legal fees to sue you.
